Consortium Random Testing Program

This is a random drug testing pool that includes multiple companies. All regulated employees from all companies are enrolled into the consortium and eligible for selection for a random drug or alcohol test. Once the required random testing percentages are met; all companies in the consortium are in compliance. Perfect for owner operators.

Stand Alone Random Program

This is a random drug testing pool with employees from just one company. Typically companies with over 12 employees elect to have a stand-alone random testing program. For example, a company with 100 truck drivers will be required to test annually 50 drivers for drugs and annually 10 drivers for alcohol. Random testing programs available for bus companies, private fleets and for hire carriers.

Consortium and Random Drug Testing

Random drug testing programs are required for employers regulated by the United Stated Department of Transportation (DOT). If you are an owner operator, you are required to be enrolled into a consortium random drug testing program. Smaller DOT regulated employers may also elect to enroll into a consortium random drug testing program for easy compliance. Larger DOT regulated employers typically request a stand-alone DOT random testing program.

OWNER-OPERATORS​

For owner-operators two important steps must be taken to comply with the DOT FMCSA regulations for drug and alcohol testing:

  1. A pre-Employment drug test with a negative result must be completed before operating a DOT covered commercial motor vehicle (CMV).
  2. You must enroll into a random testing consortium. Owner-operators are not permitted to manage random testing themselves.

Trucking Companies, Bus Companies, For Hire Carriers and Private Fleets

Both stand-alone random testing pools and consortium random testing pools are available for trucking companies, bus companies, for hire carriers and private fleets. Typically companies with over 20 drivers will elect to have a stand-alone random drug testing program. Compliance is more complicated for companies with more than one driver. WHO IS COVERED FOR DOT FMCSA DRUG & ALCOHOL TESTING?

If you drive your own truck or another company’s truck you are regulated by the Department of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA) for drug and alcohol testing. If you have a CDL and answer YES to any of the following questions, then YES you need to be in compliance with DOT drug and alcohol testing regulations.

QUESTIONS:

  1. Do you drive a vehicle that has a gross combination weight of 26,001 pounds (11,794 kilograms) or more? or
  2. Do you drive a vehicle that is capable of transporting 16 or more passengers including the driver? or

NON-DOT OR NON-REGULATED EMPLOYERS

In most states random testing of DOT safety sensitive employees is legal and a sound business practice. In some states, there may be some prohibitions against random testing of non-safety sensitive employees. Random testing is performed on an unannounced, unpredictable basis on employees whose identifying information (e.g., social security number or employee number) has been placed in a testing pool from which a scientifically arbitrary selection is made. This selection is usually computer generated to ensure that it is indeed random and that each person in the workforce population has an equal chance of being selected for testing, regardless of whether that person was recently tested or not. Because this type of testing has no advance notice, it serves as a deterrent.

Many times we get an employer calling to ask for assistance with conducting a random test on an employee who the employer thinks is acting funny or perhaps using illicit drugs. It is important to note that this is not a random drug test. This type of test is called a reasonable suspicion test and thus should be called a reasonable suspicion drug test.
